미국 헌법 개정안 제2조항은 다음과 같습니다. '잘 훈련된 민병대는 독립주 방위에 필수인 바, 주민의 무기 소지권이 침해 되어서는 안 된다.' 간단히 말해 이 법 조항에 따르면 무기를 소지할 권한이 있다는 것입니다. 헌법 개정안의 모든 조항이 그렇지만, 미국 개국 당시 이를 만들었던 헌법 제정자들의 생각을 정확하게 아는 사람은 아무도 없습니다. 이 조항의 정확한 의미에 대한 논쟁은 그동안 여러 번 있어왔고 최근에는 미 대법원에까지 제기되었습니다.
과거 미국이 갓 생겨나고 법이 거의 없던 시절, 사람들은 자신의 생명과 자산을 지키기 위해 집안에 총을 둘 필요가 있었습니다. 미국을 개척하던 시절, 낭만적인 서부 이미지가 총에 있었다고나 할까요. 사람들은 다른 사람들로부터 뿐 아니라 야생 곰과 같은 위협으로부터도 자신을 보호해야 했습니다. 총 소지를 반대하는 많은 사람들은 이러한 이유 때문에 시민이 총을 소지할 필요는 없어졌다고 주장합니다. '훈련된 민병대'라는 개정안 구절 때문에, 개인 소지가 아니라 민병대 유지를 위해서만 총을 소지할 권리가 있다는 것이 이들의 생각입니다.
국립 총기 소지회(NRA)의 회장은 오랫동안 영화배우 찰톤 헤스톤이었는데 이는 미국인의 총기 소지권을 보호하는데 앞장 서는 단체입니다. NRA의 핵심 멤버들에 따르면, 모든 시민이 어떤 총기라도 소지할 권리가 헌법에 보장 되어 있으며, 이 소유권에 대한 어떤 제재도 헌법에 위배 된다는 것입니다. 총기 로비라는 단체가 있는데 이는 NRA에 의해 일부 자금이 조달 될 뿐 아니라 총기 제조업체들이 밑받침 되는 단체로서, 국회가 총기 소지에 대한 합법화를 유지하는 것이 그들의 목적입니다.

미국은 총에 사로잡혀 있습니다. 한국에서는 개인 총기 소지가 불법인 반면, 100명의 미국인 당 약 90개의 총이 있습니다. 사람 수보다 총기류 숫자가 더 많은 주도 많이 있습니다. 많은 사람이 사냥을 위해 총을 갖고 있기도 하고 방어용으로 총기를 소지하기도 합니다. 텍사스는 다른 많은 주와 마찬가지로 총기 소지를 제한하는 법이 거의 없다고 할 수 있습니다. 하지만 허가 없이 총기를 몰래 가지고 다니는 것은 불법이며, 이를 금지하는 사인을 붙인 건물에 총기를 숨기고 들어가면 그 허가를 빼앗길 수 있습니다. 총을 지닌 사람들이 많기 때문에 미국의 권총 살해와 자살률은 무척 높습니다. 총기로 인한 사고사의 비율도 또한 높습니다. 한국의 권총 살해율이 거의 없다시피 한 것과는 대조를 이루지요.
총은 미국 문화 곳곳에 침투해 있습니다. 대부분 영화에 이런 저런 모습으로 총이 등장합니다. 제 아내는 서울에서 자라는 동안 이런 이미지의 미국을 생각하고 모든 사람이 총을 갖고 있다고 믿었답니다. 미국에 대한 그런 이미지가 꼭 맞는 것은 아니지요.
제가 한번은 취업 제의를 거절한 적이 있는데 그 건물 입구에 이렇게 쓰여 있는 글귀 때문이었습니다. '총기류 반입 금지'라고 쓰여 있었지요. 그곳에 취업을 거절한 여러 가지 다른 이유가 있기는 했지만, 그 사인이 준 인상은 많은 사람들이 그곳에 총을 가지고 들어 올수 있다는 사실이었고 이는 저를 거북하게 했습니다. 뉴스와 영화를 다 믿는다면 총은 미국 도처에 있겠지만, 사실을 말씀드리자면 실제 총을 제가 본 것은 아주 오래된 이야기랍니다.

The second amendment to the United States Constitution reads as follows: A well regulated Militia, being necessary to the security of a free State, the right of the People to keep and bear Arms, shall not be infringed. This amendment is commonly referred to simply as the right to bear arms. As with all of the amendments to the Constitution, no one really knows for sure exactly what America's founding fathers were thinking when they wrote it. The exact meaning of this amendment has been debated many times, most recently by the United States Supreme Court.
Back when America was young and there was very little law, people needed guns in their homes to protect their lives and their property. Guns took on a romantic image in the old west during America's pioneering days. People needed to protect themselves not only from lawless others, but also from such threats as wild bears. Many opponents of gun ownership argue that gun ownership by private citizens has outlived its usefulness.Opponents of gun ownership read the 'well regulated militia' part of the amendment and feel that individual citizens have the right to bear arms only in order to maintain that militia, not for personal use.
The National Rifle Association (NRA), which had as its president for many years the actor Charlton Heston, is an organization that fights to protect American people's right to bear arms. According to hard core members of the NRA, the Constitution guarantees the right to all private citizens to own any guns and any regulation of ownership is unconstitutional.There is a group called the gun lobby which is financed partly by the NRA, but also by gun manufacturers, whose job it is to convince congress that gun ownership should remain legal.
There have been challenges to the right to bear arms. Currently there is a ban on all handguns in the District of Colombia (Washington D.C.) by private citizens except former police officers. However, the Supreme Court recently heard a case which argued the gun ban was unconstitutional. The previous time the Supreme Court discussed the right to bear arms (1939) they read the amendment to refer to gun ownership in order to maintain a state militia. Though a ruling isn’t due until June, due to comments made during oral arguments, it appears that the second amendment will be read as a support of private ownership of guns.
America is obsessed with guns, there are about 90 guns for every 100 people (in contrast, private gun ownership is illegal in South Korea). In many states, there are more guns than there are people. Many people have guns for hunting, but many keep guns for protection. In Texas, as in most states, there are almost no laws limiting gun ownership, however, carrying a concealed weapon without a permit is illegal and carrying a concealed weapon into a business that has posted a sign forbidding it can result in the loss of that permit. As a result of high level of gun ownership, gun homicide and suicide rates in America are pretty high. Similarly, the level of accidental death due to guns is also high, whereas gun homicide rates in South Korea are almost nonexistent.
Guns have infiltrated American culture. Most movies involve a gun in some form or another. My wife had this image of America when she was growing up in Seoul, she believed that everyone was carrying a gun. I don't think her image is quite right though. I once turned down a job which had a sign on the door which said, "No guns allowed in the building". There were several reasons I turned down the job, but the implication of the sign said that many people would bring guns with themselves there and that made me feel uncomfortable. If we believe the news and movies, guns are everywhere in America, but truth be told, I don't think I've seen an actual gun in years.
